Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Simplo (the "Service"), operated by Simplo ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Simplo is an AI-powered social media management platform. It helps you research content ideas, generate captions and images, plan a posting calendar, and publish or schedule posts to connected social media accounts. Some features use third-party AI models to generate text and image content on your behalf.

3. Accounts and eligibility

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for all activity that occurs under your account.

4. Plans, billing and refunds

Certain actions in the Service (such as generating research, captions, or images) consume credits. Payments are processed by Stripe; Simplo does not store your full payment card details.

• Free trial. New accounts get a 3-day free trial with 75 credits. No payment details are needed.
• Plans. Growth is billed monthly or yearly, at the price shown when you subscribe. Prices exclude taxes, which are added at checkout where they apply. Subscriptions renew automatically at the end of each billing period until you cancel.
• Credits. Plan credits reset every month, on both monthly and yearly plans, and unused plan credits do not carry over. Credits from top-up packs do not expire, but can only be used while you have an active plan.
• Cancelling. You can cancel at any time from Settings → Manage Billing. Your plan stays active until the end of the period you have paid for, then it ends.
• Refunds for yearly plans. If you are not satisfied, you can ask for a full refund within 14 days of a yearly payment, including a yearly renewal, by emailing [email protected]. Once refunded, your plan ends immediately.
• No other refunds. After those 14 days, yearly payments are non-refundable. Monthly payments and top-up packs are non-refundable. All of this applies except where the law requires otherwise.
• Failed payments. If a renewal payment fails, we retry it. Your plan is paused if the payment is still unpaid 24 hours after the paid period ends, and cancelled if every retry fails.

5. Connected social accounts

The Service allows you to connect third-party social media accounts, including Instagram, Facebook, X (Twitter), and TikTok, via each platform's OAuth authorization flow. By connecting an account, you authorize Simplo to access and publish content to that account on your behalf, in accordance with the permissions you grant. Your use of each connected platform remains subject to that platform's own terms of service, and you are responsible for complying with them: Facebook, Instagram, TikTok and X.

Facebook, Instagram and TikTok accounts may be connected and published to through Post for Me (postforme.dev), a third-party publishing service owned and operated by Day Moon Development LLC that Simplo uses on your behalf. When you connect an account this way, the consent screen will name Post for Me, and your use of that connection is also subject to the Post for Me Terms of Service and Post for Me Privacy Policy. Simplo is not responsible for the availability or conduct of Post for Me or of the social platforms; if a publish fails on their side, Simplo will report it to you but cannot guarantee delivery.

6. Content and AI-generated output

The Service uses artificial intelligence to help generate captions, research summaries, and images based on inputs you provide. AI-generated output may be inaccurate, unoriginal, or unsuitable for your intended use. You are responsible for reviewing and approving all content before it is published or scheduled through the Service, and for ensuring it complies with applicable laws and the policies of the platforms you publish to.

7. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or third-party platform's terms of service
• Generate or publish content that is unlawful, defamatory, or infringes another party's intellectual property or privacy rights
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the integrity or performance of the Service

8. Intellectual property

You retain ownership of the brand assets, images, and text you upload to the Service, and of content generated at your direction using the Service. We retain all rights to the Service itself, including its software, design, and underlying technology.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably believe harms the Service or other users.

10. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Simplo is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including damages resulting from AI-generated content or from actions taken on connected social media platforms.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
